Nordson Corporation, as the plaintiff, recently received rulings from the Shanghai Intellectual Property Court (the “Court”), against NDC Spray Coating System Fabricating Co., Ltd. (“NDC”), as the defendant, a company located in the Fujian Province, Southeast China. The Court ruled that NDC’s products at issue, i.e., NDC Universal Module and the NDC String Nozzle for the application of adhesive onto stretched elastic strands, infringe, respectively, the relevant claims of Chinese Patent No. 02107773.8 (Universal Module Patent) and Chinese Patent No. 03812627.3 (SureWrap Nozzle Patent) owned by Nordson in China. The Court ordered the defendant NDC to immediately cease and desist from infringement on Nordson’s relevant patents, and further awarded the plaintiff Nordson damages and reasonable expenses.
Nordson is a manufacturer of adhesive dispensing equipment, and the foremost patent holder in relation thereto across the world including China. In 2011, it came to Nordson’s attention that NDC was producing, selling and offering for sale, without Nordson’s authorization, the above mentioned adhesive dispensing devices which infringed Nordson’s respective patents. After careful investigation and evidence collection, Nordson filed patent infringement grievances against NDC, seeking both injunctions and damages. The main disputes in the litigation focused on whether NDC’s accused infringing products fell within the scope of protection of Nordson’s relevant patents. Nordson has recently secured the Court’s full support in these Chinese lawsuits.
