Clopay Plastics Products, the Mason, OH-based supplier to the hygiene market, has filed a suit Wednesday that accuses a rival of misappropriating its trade secrets covering breathable liners used in baby and adult diapers. Clopay is part of Griffon Corp., a New York, NY-based specialty building and healthcare products maker with 2014 sales of about $2 billion. Its Clopay unit sued Evansville, IN-based Berry. Clopay contends Berry, with $5 billion in sales last year, should pay damages for allegedly hiring its employees and obtaining confidential data on the liners, according to a report in Bloomberg News.
"Berry Plastics has, for years, been unable to equal Clopay's breathable film performance in the industry," and decided to "aggressively seek out" information surreptitiously, Clopay said in its complaint filed Wednesday in Delaware Chancery Court in Wilmington. The court, which specializes in handling business litigation, is an outgrowth of Delaware's unique position as being the place where many companies are incorporated, making the state their legal home.
Eva Schmitz, a Berry spokeswoman, told Bloomberg the company doesn't comment on pending legal matters.
In the suit, Clopay lawyers seek an order barring Berry from using its inventions, plus compensation for unjust enrichment, Bloomberg said
