Tampax maker Procter & Gamble has filed a lawsuit against privately owned First Quality Hygienic Inc. alleging trademark infringement and unfair competition for making and distributing a "look-alike" brand of tamponsThe suit, filed in Federal District Court for the Eastern District of New York, claims that a tampon sold by First Quality “infringes on the registered trademarks and packaging trade dress of P&G's Tampax Pearl tampons.”
First Quality's tampon is sold in Canada under the name Life Brand. First Quality Hygienic is a subsidiary of First Quality Enterprise Inc., based in Great Neck, NY.
The suit is P&G’s latest attempt to keep private label companies from marketing products with similar packaging or other attributes at its branded products. Other P&G products reportedly being infringed upon by private labelers are Charmin toilet paper, NyQuil cough medicine and Crest toothpaste.
